Chandigarh, May 30, 2018: Any housing society in Haryana shall not charge more than Rs 10,000 as transfer fee in case of change of ownership of apartment; shall fix charges for maintenance of common area and facilities on the basis of the size of the apartment; and all existing societies will modify their by-laws accordingly and get these approved by the district registrar.
To pave the way for these, the Haryana Cabinet which met under the chairmanship of the Chief Minister, Mr Manohar Lal, here today, approved an amendment to the Haryana Registration and Regulations of Societies Rules, 2012.
At present, there is no provision under the rules with regard to the amount of transfer fee and maintenance charges.
The amendment also allows for extension of time limit for obtaining new registration number by the existing societies registered under the Societies Registration Act, 1860, and for fixing transfer fee in respect of transfer of apartment and fixing of maintenance charges charged by governing body of the society formed by apartment owners.
According to the amendment, every existing society will apply to the district registrar for allotment of a new registration number within a period of two years from the date of coming into force of the Act without any fee, or, within next 57 months and three days that is upto December 31,2018, on payment of fee set out in the Schedule of fees, which implies, the societies can now register under the new Act till March 28,2019.
The time-limit for getting new registration number had expired on March 28, 2017.
